This is a release of liability; YOU MUST READ AND FULLY UNDERSTAND BEFORE SIGNING.
I acknowledge that I voluntarily have applied to participate in mock battles involving operation of a “tank” which includes paintballs being launched at me by other participants. I understand that this activity requires me to wear protective gear, and I agree to adhere to all safety and game rules to ensure my safety, the safety of other participants, and the safety of the employees of OddBall Tactics.
I understand that this activity involves known and unknown risks of injury to myself and to other people, which includes but is not limited to death, permanent or temporary paralysis, disability, illness or disease, physical or mental damage, or other injury. Some of these risks include latent or apparent defects or conditions in equipment, and passive or active negligent acts of myself, Okaloosa County, business owner, property owner, other participants. I understand that the prior list of risks is not complete or exhaustive, and that those and other risks known or unknown, anticipated or unanticipated may also result in injury, death, illness, disease, to myself/property/other third parties. I voluntarily agree and promise to accept and assume any and all responsibilities and injury, death, illness, disease or damage to myself or my property arising from my participation in this activity. I further understand that Okaloosa County assumes no liability for loss, damage or any kind of injury sustained by myself or my property while using/participating in this outdoor activity at OddBall Tactics Paintball Tank Park.
I THEREFORE ASSUME ALL RISKS ASSOCIATED WITH PARTICIPATING IN ACTIVITIES AT THE OUTDOOR PAINTBALL TANK PARK EVEN IF THEY ARISE FROM THE NEGLIGENCE OF OKALOOSA COUNTY, PROPERTY OWNERS, BUSINESS OWNERS/MANAGERS/EMPLOYEES, AND FELLOW PATRONS. My participation in this activity is voluntary and no one is forcing me to participate in spite of the risks. I understand the effect of this waiver and acceptance the risk on my legal rights.
By signing this release of liability and participating at OddBall Tactics Paintball Tank Park I hereby fully and forever release and discharge indemnify and hold harmless OddBall Tactics and their employees and agents and fellow patrons from any and all liabilities, claims, demands, damages, rights of action, suits or causes of action present and future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of my use or intended use of said outdoor tank park, tank park equipment, and location of premise.
In conjunction, if I have imbibed alcohol (or other intoxicants, whether prescription, legal or illegal) I will not hold the facility employees, owners, managers, fellow patrons, or Okaloosa County responsible for the additional risks incurred, whether known or unknown, anticipated or unanticipated which may also result in injury, death, disease, illness to myself/property/other third parties. I fully and forever release and discharge OddBall Tactics and their employees and agents from any and all negligent acts and omissions in the same, and intend to be legally bound by this release.
